OWI CLIENT/VISA APPLICANT GENERAL TERMS & CONDITIONS
OWI Australia (OWI) is delighted to provide OWI clients and visa applicants with immigration assistance, including for visa applications and other visa and immigration support services.
OWI Australia (LPN 5510196) aims to provide you with excellent and professional visa and immigration services to clients around the world who wish to enter into Australia by temporary, permanent or bridging visa, for any lawful reason, including for work, business, education, family, humanitarian, holidays, special events, immigration and citizenship.
By engaging OWI to provide visa and immigration assistance to you, you (or your firm as the case may be) agree to the terms and conditions as specified in the “Confirmation of Appointment of OWI Australia” email correspondence and these General Terms and Conditions. These General Terms and Conditions incorporate the OWI Website Terms of Use and Privacy terms and conditions.
By the Confirmation of Appointment, you agree to appoint OWI to provide you with visa and immigration assistance and to represent your interests in working with the Australian Government - Department of Home Affairs (DOHA) and other Australian government and non-government organisations as required, for you to obtain your Australian visa(s). Please read these general terms and conditions carefully to ensure you understand your rights and obligations arising from the Confirmation of Appointment.
These general terms and conditions of appointment are consistent with the laws of Australia and the laws applicable to legal practitioners of Australia, because OWI is ultimately owned and controlled by an Australian Legal Practitioner (Hugh Piper) approved by the Australian Government and High Court of Australia and State Courts to practice immigration law and to represent clients in Australian tribunals and Courts, if needed.
Fees Charged by OWI
OWI charges fees to you the Client / Visa Applicant at the rates and in the amounts disclosed and as estimated in the Confirmation of Appointment email correspondence.
OWI fees relate to time charges and the nature of the services provided to you by OWI Australia. OWI fees exclude Australian Government fees and charges (such as visa lodgment fees for example) and other fees and costs required to be paid to third parties involved in the immigration and visa application services, such as for e-medical reports, language classes, police checks, etc.
OWI fees and charges may also include costs and disbursements paid by OWI on your behalf with your prior approval, for the purpose of providing you with the immigration and visa application services. In Australia, all fees charged by OWI must include “Goods and Services Tax” (GST), an Australian Government tax of 10% of the OWI fee, which OWI must pay to the Australian Taxation Office, when the client pays the OWI fee.
OWI Australia will send you an invoice for the OWI Fees from time to time as set out in the Confirmation of Appointment.
Termination of the Appointment of OWI.
You may terminate the appointment of OWI Australia at any time by notifying OWI Australia. There is no cost or penalty for terminating our services and no reasons need to be given for the termination. OWI Australia respects all clients and visa applicants in the same way and will not question or object to the termination of its services.
OWI Australia will also act and advise to the best of its ability so that its clients and visa applicants obey all Australian laws. OWI may terminate its services for any client / visa applicant at its discretion with reasons given, and will protect its own interests if and when any client or visa applicant contravenes Australian law or behaves unethically or disrespectfully towards any OWI Consultant or third party.
OWI Australia Electronic Communications and Transactions with Client
Pursuant to Australian federal and state electronic transactions laws and to the extent permitted by those laws, the client, visa applicant and OWI agree and consent to the use of electronic signatures and electronic communications to create legally binding obligations and undertakings for the purposes of any visa application and other immigration services provided by OWI.
OWI Australia Client / Visa Applicant Documentation
On completion of the immigration and or visa application services, OWI will retain electronic copies of relevant client and visa application documents. All original documents if any provided by the client and or visa applicant will be returned to the client / visa applicant.
The Australian Laws Governing the Appointment of OWI Australia
The appointment of OWI Australia and the specific and general terms and conditions of appointment of OWI is governed by the federal and state laws of Australia. These laws include the uniform laws and rules applicable to the legal profession and the contractual relationship between Australian lawyers and their clients.
OWI Client / Visa Applicant Acknowledgement of and Agreement with these General Terms and Conditions.
By appointing OWI Australia in accordance with the Confirmation of Appointment, the client / visa applicant agrees to these General Terms and Conditions.
